These Terms of Service ("Terms") form a legally binding contract between you and InstaSportsInfo, Inc., a Delaware corporation ("InstaSportsInfo," "we," "us," or "our"), governing your access to and use of the InstaPickleball mobile application and the website at https://www.instapickleball.info (together, the "Services").
PLEASE READ CAREFULLY. SECTION 19 CONTAINS A MANDATORY ARBITRATION AGREEMENT AND A CLASS-ACTION WAIVER WHICH AFFECT HOW DISPUTES BETWEEN YOU AND US ARE RESOLVED. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS OF FIRST USING THE SERVICES.
By creating an account, downloading the app, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility
You may use the Services only if:
- You are at least 13 years old.
- If you are between 13 and the age of majority in your jurisdiction (typically 18), you have permission from, and are supervised by, a parent or legal guardian who has agreed to these Terms on your behalf.
- You have the legal capacity to enter into a binding contract.
- You are not barred from using the Services under applicable law.
- You are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country.
The Services are currently offered in the United States and Canada only. We are not currently authorized to offer the Services in other countries, and you should not use the Services from outside the United States or Canada.
2. Account Registration & Authentication
To use most features, you must create an account. You may register with:
- Email and password
- Sign in with Apple
- Google Sign-In
You agree to provide accurate information and to keep it current. You are responsible for keeping your credentials confidential and for all activity on your account. Notify us immediately at support@instapickleball.info if you suspect unauthorized use.
We reserve the right to reject, suspend, or remove accounts at our discretion, including for violation of these Terms, suspected fraud, or abusive behavior.
3. License to Use the Services
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the InstaPickleball app on devices that you own or control, solely for your personal, non-commercial use.
You may not:
- Copy, modify, or create derivative works of the Services
- Reverse engineer, decompile, or disassemble the Services, except to the extent applicable law permits otherwise
- Resell, sublicense, or commercially exploit the Services
- Remove or obscure any proprietary notices
All right, title, and interest in and to the Services (other than your User Content) are and will remain the exclusive property of InstaSportsInfo and its licensors.
4. User Content
4.1 What is User Content
"User Content" means everything you submit, upload, post, or transmit through the Services, including:
- Profile information (name, photo, gender, location, DUPR ID)
- Court photos
- Court Live Status reports
- Edits and additions you propose to court information (Court FAQ answers, hours, fees, amenities)
- Messages in 1:1 and group conversations
- Sessions you create
- Peer ratings
4.2 You Own Your User Content; You License It to Us
You retain ownership of your User Content. By submitting User Content, you grant InstaSportsInfo a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, transferable license to host, store, reproduce, modify (for example, resize photos or blur faces), publish, display, distribute, translate, and otherwise use your User Content in connection with operating, providing, and improving the Services and our marketing of the Services.
This license continues after your account is deleted only to the extent your User Content was shared with other users (for example, messages already received in a group chat, or court edits that have been merged), because removing it would alter other users' record of those interactions.
4.3 Your Representations About User Content
You represent and warrant that:
- You own or have all necessary rights to the User Content you submit.
- Your User Content does not infringe any third-party intellectual property, publicity, privacy, or other right.
- Your User Content does not contain personal information about identifiable third parties without their consent.
- Your User Content is not false, misleading, defamatory, harassing, threatening, obscene, hateful, or otherwise unlawful.
4.4 Content Moderation
We may use automated filters, manual review, user reports, and other safety tools to detect or respond to User Content or conduct that violates these Terms or that we judge harmful, abusive, misleading, or in poor taste. We are not responsible for User Content posted by users, and we do not guarantee that all User Content will be reviewed before it appears in the Services.
You can report safety issues in-app by opening the relevant user's profile, tapping the menu icon, and choosing the report option. You can also contact us at support@instapickleball.info. When reporting a specific message, photo, court update, session, or other content item, please include enough detail for us to identify it.
We review user reports within 24 hours. If we determine that a violation occurred, we may take action including warning the user by in-app official message, removing or restricting access to content, temporarily suspending the account, permanently banning the account, or taking other steps we consider appropriate. For suspensions and bans, we may notify the affected user by in-app official message and by email to the address associated with the account.
Users may block other users from their profile or an existing 1:1 chat. Blocking is intended to limit unwanted interaction and may hide the blocked user from map markers, player lists, shared 1:1 chats, and similar personal discovery surfaces. Blocking does not replace reporting; please report threats, harassment, impersonation, or other safety concerns so we can review them.
If you believe there is an emergency or immediate risk of physical harm, contact local emergency services first. The Services are not an emergency reporting system.
5. Credits System
The Services include an in-app virtual unit called "credits." You agree to the following:
- Credits are a license to use a feature of the Services. They are not legal tender, not money, not a stored-value instrument, and not redeemable for cash. You may not transfer, sell, or exchange credits with other users or any third party.
- Credits may be used within the Services to access in-app features, including putting down a deposit on a Session (Section 6), boosting a Session's visibility, and claiming eligible promotional offers from partner courts (such as court time, ball machine sessions, clinics, events, or other partner perks). We may add, remove, or modify redemption options at our discretion.
- You may earn credits through promotions, referrals, or other in-app actions we designate.
- We may deduct credits for behavior that violates these Terms or session-specific rules — for example, no-shows or late cancellations as described in Section 6.
- Credits are personal to your account. You may not transfer them, sell them, exchange them for cash, or use them outside the Services.
- Credit balances may expire, be reset, capped, or modified at our discretion. We will provide reasonable notice of material changes.
- If your account is suspended or terminated for violation of these Terms, any credit balance is forfeited.
- We are not obligated to refund credits in any circumstance.
We do not currently sell credits for money. If we add purchasable credits in the future, we will update these Terms before doing so.
6. Sessions & Deposits
Sessions are pickleball game gatherings organized by users. We provide the platform; users are responsible for organizing, attending, and conducting Sessions.
When you create or join a Session, you may be required to put down a deposit denominated in credits. Deposits are intended to encourage commitment and discourage no-shows. The session organizer sets the deposit amount within limits we may set.
The deposit may be forfeited under conditions described in the in-app Session rules, including:
- Failure to check in within the required window
- Late cancellation
- No-show
- Violation of session-specific rules set by the organizer
Forfeited credits may be redistributed to attending participants, returned to the organizer, or retained by us, as described in the in-app rules at the time of the Session.
We are not a party to the Session itself and are not responsible for disputes between participants. Disputes about Session conduct, attendance, or deposit forfeiture should be raised first with the session organizer; if not resolved, you may contact support@instapickleball.info.
7. Court Information & Community Edits
The Services display information about pickleball courts, including locations, hours, fees, amenities, contact information, photos, and frequently asked questions ("Court Information"). Court Information is, in part, contributed and edited by users.
- No warranty. Court Information is provided "as is." We do not guarantee its accuracy, completeness, or timeliness. Always verify with the court operator before relying on hours, fees, or rules.
- Edit submissions. You may propose edits to Court Information. Submissions are subject to review by our team or designated court managers and may be approved, modified, or rejected at our discretion.
- Single-pending lock. While an edit submission is pending, others may not submit conflicting edits to the same court until your submission is acted on or withdrawn.
- License. By submitting an edit, you agree that the merged content becomes part of the Services under the license described in Section 4.2 and that we may credit, modify, or remove your contribution.
8. DUPR Verification
The Services display DUPR (Dynamic Universal Pickleball Rating) singles and doubles ratings as a third-party reference for player skill level.
- You provide your DUPR ID voluntarily.
- We verify by manual lookup. When you submit a DUPR ID, you authorize us to look up your public DUPR profile on dupr.com and copy the publicly displayed singles and doubles ratings into your InstaPickleball profile.
- We do not transmit your data to DUPR. We only read public information from DUPR's website.
- Verification is informational, not a guarantee. We are not affiliated with, endorsed by, or partnered with DUPR. We do not guarantee that the rating shown is current or accurate.
- DUPR is a trademark of its owner. Any use here is purely descriptive.
- You can request unlinking at any time by contacting support@instapickleball.info or using the in-app unlink option.
9. Live Status Reports
The Services let users post short-form Court Live Status reports describing how busy a court is, optionally including a photo. To protect bystanders' privacy:
- Photos uploaded to Live Status are automatically blurred to obscure faces.
- You agree not to attempt to bypass the blurring or to post images that identify individuals without their consent.
- You agree not to post Live Status reports that are misleading or intended to harass or defame the court, its operators, or other players.
10. Prohibited Activities
You agree not to:
(a) Use the Services for any illegal, harmful, or fraudulent purpose;
(b) Impersonate any person or misrepresent your affiliation;
(c) Harass, threaten, abuse, stalk, defame, or discriminate against any person;
(d) Post sexual content, hate speech, violent content, or content that exploits minors;
(e) Post personal information (including photos) of identifiable people without their consent;
(f) Send spam, chain messages, or unsolicited commercial messages;
(g) Solicit funds, donations, or commercial transactions through the Services without our prior written permission;
(h) Scrape, crawl, or otherwise systematically extract data from the Services;
(i) Attempt to access accounts, data, or systems you are not authorized to access;
(j) Interfere with, probe, or test the security of the Services, including running denial-of-service attacks;
(k) Use bots, scripts, or other automated means to access or interact with the Services;
(l) Reverse engineer, decompile, or attempt to derive the source code of the Services, except as permitted by law;
(m) Use the Services in any way that could damage or overload our infrastructure or networks;
(n) Encourage or enable any of the foregoing.
We may suspend or terminate your account at any time for any violation, suspected violation, or for no reason at all.
11. ASSUMPTION OF RISK FOR IN-PERSON ACTIVITIES
Pickleball is a physical sport played in person. The Services connect you with other users for the purpose of meeting and playing in real life. By using the Services, you acknowledge and agree to the following:
(a) You play at your own risk. Pickleball involves physical exertion and a risk of injury, including (without limitation) sprains, strains, broken bones, falls, head injuries, cardiac events, and other harm.
(b) You are responsible for your own safety and fitness. You represent that you are physically fit to play and that you have obtained any medical clearance you require.
(c) We do not screen, vet, supervise, or endorse other users. Other users may misrepresent themselves, behave inappropriately, or pose risks. We are not responsible for the conduct of other users, whether online or in person.
(d) You meet other users at your own discretion. When you meet someone through the Services in person — at a court, a Session, or elsewhere — you do so at your own risk. We strongly encourage you to meet in public places, tell someone where you will be, and exercise good judgment.
(e) We are not a coach, referee, instructor, league, sponsor, or referral service. We provide a platform that lets users find each other; we do not organize or supervise games.
(f) No liability for in-person harm. To the maximum extent permitted by law, you release InstaSportsInfo, its directors, officers, employees, contractors, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) of every kind and nature arising out of or related to your in-person interactions with other users introduced through the Services, including injuries, illness, theft, harassment, accidents, property damage, and any criminal or tortious conduct by another user.
(g) Court rules and operator policies. Pickleball courts have their own rules, fees, hours, dress codes, and reservation systems. You are responsible for following them.
12. Mobile Application License (Apple & Google)
This Section applies to your use of the InstaPickleball mobile app downloaded from the Apple App Store or Google Play.
12.1 General
The license granted to you in Section 3 is limited to use on devices running iOS or Android. The app, its content, and any updates remain the property of InstaSportsInfo and its licensors.
12.2 Apple App Store Terms
If you obtained the app from the Apple App Store, you acknowledge:
- These Terms are between you and InstaSportsInfo only, not with Apple Inc., and Apple is not responsible for the app or its contents.
- The license granted to you for the app is limited to use on Apple-branded devices that you own or control, as permitted by the Apple App Store Usage Rules.
- Apple has no obligation to provide maintenance or support for the app.
- In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (the InstaPickleball app is currently free). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Claims relating to the app's possession or use (including product liability, consumer protection, and intellectual-property claims) are the responsibility of InstaSportsInfo, not Apple.
- You represent that you are not located in a U.S.-embargoed country and are not on any U.S. government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12.3 Google Play Terms
If you obtained the app from Google Play, your use is also subject to the Google Play Terms of Service. You acknowledge that Google has no obligation to provide maintenance or support for the app and is not liable for any claims related to the app.
13. Modifications to the Services
We may, at any time and at our discretion, change, suspend, or discontinue the Services or any feature, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.
We may also revise these Terms. When we do, we will update the "Last Updated" date at the top. For material changes, we will provide reasonable advance notice through the app, by email, or both. Your continued use of the Services after a change takes effect means you accept the updated Terms.
14. Term & Termination
These Terms remain in effect while you use the Services.
You may terminate at any time by deleting your account in-app or by emailing support@instapickleball.info from your registered email address.
We may suspend or terminate your account or access at any time, with or without cause and with or without notice, including if you violate these Terms.
Upon termination:
- Your license to use the Services ends immediately.
- Your access to the app and your account ends.
- Your User Content remains in shared spaces as described in Section 4.2.
- Any unpaid amounts you owe survive termination.
- Sections 4.2, 5, 6, 11, 15, 16, 17, 18, 19, 20, 21, and 22 survive termination.
15. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTASPORTSINFO AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT:
- THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
- INFORMATION ABOUT COURTS, PLAYERS, SESSIONS, OR DUPR RATINGS WILL BE ACCURATE, COMPLETE, OR CURRENT.
- ANY OTHER USER WILL BEHAVE AS REPRESENTED OR WILL ACTUALLY MEET YOU FOR A SESSION.
- DEFECTS WILL BE CORRECTED.
NO ADVICE OR INFORMATION OBTAINED FROM US OR THROUGH THE SERVICES CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the foregoing exclusions apply to the maximum extent permitted by law.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
(a) IN NO EVENT WILL INSTASPORTSINFO, ITS AFFILIATES, OR ANY OF THEIR DIRECTORS, OFFICERS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
(b) OUR AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS IS LIMITED TO THE GREATER OF (i) ONE HUNDRED U.S. DOLLARS (US$100) OR (ii) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
(c) The limitations above apply whether the claim is based in contract, tort (including negligence), strict liability, or any other legal theory, and even if a remedy fails of its essential purpose.
(d) Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
17. Indemnification
You will defend, indemnify, and hold harmless InstaSportsInfo, its affiliates, and their respective directors, officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
(a) Your use of the Services;
(b) Your User Content;
(c) Your violation of these Terms;
(d) Your violation of any law or third-party right;
(e) Your in-person interaction with any other user introduced through the Services.
We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us. You agree to cooperate with our defense.
18. Governing Law
These Terms and any dispute arising out of or related to the Services are governed by the laws of the State of California, without regard to its conflict-of-law rules. Subject to the arbitration provision in Section 19, the federal and state courts located in Los Angeles County, California have exclusive jurisdiction over any claim not subject to arbitration, and you and we consent to personal jurisdiction in those courts.
19. Dispute Resolution; Arbitration; Class-Action Waiver
READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO RESOLVE DISPUTES WITH US THROUGH BINDING INDIVIDUAL ARBITRATION AND TO GIVE UP YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING. YOU MAY OPT OUT OF THIS AGREEMENT WITHIN 30 DAYS OF FIRST USING THE SERVICES BY EMAILING support@instapickleball.info WITH "ARBITRATION OPT-OUT" IN THE SUBJECT LINE.
19.1 Informal Resolution
Before filing arbitration, you agree to first send a written notice of dispute to support@instapickleball.info describing the nature and basis of the claim and the relief sought. We will attempt to resolve the dispute informally for at least 30 days. If we cannot resolve it within 30 days, either party may proceed to arbitration.
19.2 Binding Arbitration
Except for disputes that may be brought in small claims court (Section 19.5) and except for the right to seek injunctive relief in court for intellectual-property infringement (Section 19.6), all disputes between you and InstaSportsInfo arising out of or related to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms.
- The arbitration will be conducted by a single arbitrator.
- The arbitration will be held in Los Angeles County, California, or by telephone or video conference at your election.
- The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.
- The Federal Arbitration Act governs the interpretation and enforcement of this Section.
19.3 Class-Action Waiver
YOU AND INSTASPORTSINFO AGREE TO BRING DISPUTES ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS PART OF ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If this class-action waiver is found unenforceable, then the entirety of Section 19.2 is null and void, but the rest of these Terms remain enforceable.
19.4 Opt-Out
You may opt out of this arbitration agreement (Sections 19.2 and 19.3) by sending an email to support@instapickleball.info with "ARBITRATION OPT-OUT" in the subject line within 30 days of the date you first accept these Terms. The email must include your name and the email address associated with your account. If you opt out, neither you nor InstaSportsInfo can require the other to arbitrate.
19.5 Small Claims Carve-Out
Either party may bring an individual claim in small claims court if the claim qualifies and stays in small claims court.
19.6 Injunctive Relief
Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual-property rights or unauthorized access to the Services.
19.7 Costs
Each party will pay its own attorneys' fees and costs except as expressly required by AAA rules or by law. AAA filing fees are governed by AAA's Consumer Arbitration Rules.
20. DMCA / Copyright Notices
If you believe that User Content posted on the Services infringes your copyright, please send a written notice to our designated copyright agent:

Your notice must include the information required by the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), including:
(a) A physical or electronic signature of the copyright owner or authorized agent;
(b) Identification of the copyrighted work claimed to be infringed;
(c) Identification of the material claimed to be infringing and where it is on the Services;
(d) Your contact information;
(e) A statement that you have a good-faith belief the use is not authorized;
(f) A statement, under penalty of perjury, that the information is accurate and that you are authorized to act.
We will respond to valid notices in accordance with the DMCA. We may terminate accounts of repeat infringers.
21. Miscellaneous
Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Services and supersede any prior agreements.
Severability. If any provision is held unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms freely (for example, to a successor in a merger or acquisition).
No Agency. No agency, partnership, joint venture, or employment relationship is created by these Terms.
Force Majeure. We are not liable for any delay or failure due to causes beyond our reasonable control (natural disasters, wars, pandemics, government actions, infrastructure outages, and the like).
Notices. Notices to you may be given by email to the address on your account or by in-app notification. Notices to us must be sent to the address in Section 22.
Headings. Headings are for reference only and do not affect interpretation.
Language. These Terms are made available in English. Any translations are for convenience only; the English version controls.
Third-Party Beneficiaries. Apple and its subsidiaries are third-party beneficiaries of Section 12.2 and may enforce its provisions against you. Otherwise, there are no third-party beneficiaries.
